Loss mitigation has become a major effort for financial institutions during the market turmoil, but the effort to help homeowners and protect against losses raises fair lending and compliance issues. Federal regulators are closely reviewing banks' practices to ensure consumers are treated fairly and legally and that banks are in full compliance. What form of monitoring is expected or desirable? What issues are raised when lines are frozen or accounts closed? These topics and many more will be the subject of this important webinar.

This presentation is an updated and more in-depth version of one of the most popular sessions at CBA's Fair Lending Conference. Those compliance, legal and risk management officers who could not attend the conference and those who would like to follow up on the conference presentation will find this to be valuable. This webinar will also be of great benefit to those in servicing, collection and loss mitigation departments, who need to better understand this part of the business.

Industry experts Amy Matsuo, Director, KPMG, Anand Raman, Esq., Partner, Skadden, Arps, Slate, Meagher & Flom, LLP, and Steve Zeisel, Esq., Vice President and Senior Counsel, Consumer Bankers Association will discuss these issues and will describe public policy and legal concerns. They will also address how the regulatory agencies may consider these issues.

You will learn:

  • Issues that are being pursued in regulatory examinations regarding servicing and loan modification

  • What kinds of fair lending monitoring and testing are being done in servicing and loss mitigation

  • How to mitigate the inherent compliance and fair lending risks associated with loan servicing
