About the Webinar:

Recently, the Federal Reserve published a final rule amending Regulation Z, implementing the Truth of Lending Act pursuant to the enactment of new disclosure requirements on private, non-federal student loans as required under the Higher Education Opportunity Act (HEOA).

The final rule fundamentally modifies disclosure requirements on non-federal student loans and creates new compliance challenges for loan providers. The new requirements go into effect September 14 with compliance optional until February 14, 2010.

This webinar focuses on these new requirements, what you need to know, and what you need to do in order to assure full compliance by next February. Among the many significant new requirements under the final rule are:

  • Prohibiting raising rates on existing balances except for 60-day delinquency
  • Three sets of detailed TILA disclosures to be made at the time of application, loan approval and consummation.
  • New exposure to civil liability, but also a safe harbor available through use of model forms.
  • Application of the final rule to tuition billing plans and other extensions of credit made by educational institutions.

Lattin
Brent Lattin is a Senior Attorney in the Division of Consumer and Community Affairs of the Federal Reserve Board in Washington, DC. Mr. Lattin works on regulations implementing several federal statutes governing consumer financial services, including the Truth in Lending Act. He received his bachelor's degree from Stanford University and his law degree from the University of Chicago. He is admitted to practice law in the District of Columbia.
 LavetRobert Lavet is a Principal in the Education Practice group of the Washington D.C. law firm, Powers Pyles Sutter & Verville PC. He regularly counsels post-secondary institutions and both established and start-up financial services firms on a variety of regulatory, litigation and transactional matters. Prior to joining Powers Pyles Sutter & Verville, Mr. Lavet served as Senior Vice President and General Counsel of SLM Corporation ("Sallie Mae"), a Fortune 300 Company and the leading provider of education finance, from 2005 until January 2008. In that capacity he was responsible for managing all legal affairs for Sallie Mae and its subsidiaries and also had responsibility for the Corporate Compliance function and loan servicing policy.

 Tom P. Levandowski is Senior Vice President and Assistant General Counsel for Wells Fargo & Company. He is recognized as a leading expert in federal regulation of both federal and non-federal student loans. He represents Wells Fargo on the CBA Education Funding Committee and is active in student loan industry legal practitioner groups. Prior to his current position with Wells Fargo, Tom served as Legal Counsel and Director of Legal and Regulatory Affairs for Educaid (1994-1999), and before then held various positions within the Higher Education Assistance Foundation (1986-1993).
 John CulhaneJohn L. Culhane, Jr. is a partner in the Business & Finance Department and a member of the Consumer Financial Services Group, Higher Education Industry Group, and the Corporate Compliance and Investigations Group. His practice emphasizes counseling clients on interstate direct and indirect consumer and residential mortgage loan and leasing programs, through both traditional brick and mortar facilities and e-commerce.
